Terms & Conditions - Seminars & Workshops

 

These terms & conditions apply to each order that Chambers Corporation Pty Ltd ACN 102 189 408 t/a Presidian Legal Publications ("Presidian") accepts from a customer ("You") for a workshop and/or seminar ("Workshop").  

1

Payment

 

Payment must be received prior to attendance. Credit card payments attract a 2.5% surcharge.

Bookings & cancellations

 

Bookings must be received before the relevant booking deadline. Cancellations prior to the booking deadline will attract a 5% cancellation fee. Cancellations after the booking deadline will attract a 50% cancellation fee. In limited circumstances, it may be necessary for Presidian to refuse a cancellation within 48 hours of a Workshop and we reserve the right to do this.  Presidian also reserves the right to  cancel a workshop (eg. due to insufficient attendance) in which case you will be entitled to a full refund.

Catering

 

If catering is provided at the Workshop, you agree to notify us at the time of registration as to any special dietary requirements you have so that we may notify our caterers accordingly.    

4. 

Does not constitute legal advice

 

The Purchaser acknowledges and agrees that the Workshop and any materials provided at it ("Materials") are not intended to be, nor constitute, legal or other professional advice.   

5.

Limitation of liability and indemnity

 

(1)

To the extent permitted by law Presidian and/or all other persons involved in the preparation, production and/or presentation of the Workshop and/or Materials ("Presidian and/or Its Agents") will be under no liability whatsoever to you in respect of any loss or damage (including consequential loss or damage) which you may suffer or incur (directly or indirectly) in connection with or as a result of the Workshop and/or this agreement ("Agreement") whether arising from any act or omission negligent or otherwise by Presidian and/or Its Agents.

 

(2)

Without limiting sub-clause (1), if Presidian and/or Its Agents are rendered liable in any way in relation to, or arising from, the Workshop or this Agreement, such liability will, at the option of Presidian and to the extent permitted by law, be limited to a refund of the registration fee.

6.

No warranties

 

(1)

Subject to sub-clause (2):

 

 

(a)

the Workshop and Materials are provided without warranties of any kind, either express or implied; and

 

 

(b)

any condition or warranty which would otherwise be implied in the Agreement is hereby excluded.

 

(2)

Where legislation or other law implies any condition or warranty in relation to this Agreement, and that law avoids or prohibits provisions in a contract excluding or modifying the application of or exercise of or liability under such condition or warranty, the condition or warranty is included or implied in the Agreement.  Presidian’s liability under any such condition or warranty will, at the option of Presidian and to the extent permitted by law, be limited to the price of the Workshop.

7. 

Programme & venue variation

 

Presidian may change the venue of the Workshop for any reason (eg. higher than anticipated attendance numbers).  Presidian may vary the Workshop programme to deal with any unforeseen circumstances, provided the content of the Workshop  is not substantially altered. 

8.

Severance

 

Every provision of this document is independent of the other and any provision, or part of a provision, which is prohibited or unenforceable in any jurisdiction will be ineffective to the extent only of such prohibition or unenforceability and the other part or parts of the provision (if any) and all other provisions of this Agreement will remain in force.

9. 

Governing Law

 

The laws of South Australia in Australia govern this Agreement and the parties expressly submit to the exclusive jurisdiction of the courts and tribunals of that State.

10. 

Entire Agreement

 

The Agreement supersedes all previous oral and written agreements or arrangements, if any, in respect of its subject matter and embodies the entire agreement between the parties.

11. 

Privacy

 

Presidian may handle your personal information in accordance with its Privacy Policy (available from our website).  We may also use your information to send you details about our current or future products relating to the topic of the Workshop.  You may request to be removed from our mailing list at any time.
