Privacy Act reforms: from the NPPs to the APPs

Assessing the impact on the private sector

Duration: 1.5 hrs  |  July 2010                                                                        CPD Points: 1.5

Download PDF  |  Download registration form  |  Public sector seminar (IPPs)

Seminar description  This seminar provides a detailed overview of proposed changes to the Privacy Act 1988 (Cth) following the release of the Government’s exposure draft legislation (on 24 June 2010) setting out the Australian Privacy Principles (APPs) which are to replace the private sector National Privacy Principles (NPPs).

The seminar will:
·       provide an overview of the proposed APPs;
·       undertake a gap analysis between the APPs and NPPs identifying:
     -  APP obligations that are the same as, or similar to, existing NPP obligations;
     -  new obligations under the APPs;
·       assess the impact of the new obligations;
·       provide insight into how the new obligations may apply in practice;
·       provide an overview of other proposed changes to the Act.

Key areas of focus will be the proposed new obligations regarding:

·       privacy collection notices and privacy policies;

·     direct marketing (a new “direct marketing” principle restricts when information can be used and disclosed for direct marketing purposes and requires the provision of opt-out facilities);

·     disclosures to entities overseas (entities will remain liable for breaches of the APPs by overseas recipients); and

·       procedures and systems that must be in place to ensure compliance with the APPs.

The seminars will be of interest to practitioners advising clients on the scope and impact of the proposed changes and in-house counsel and privacy officers preparing submissions during the public consultation period (materials can be ordered ahead of the seminar – tick the box under "Request delivery of seminar materials prior to seminar" on the registration form).

Seminar materials  Attendees will receive a bound handbook containing:
·    seminar materials; and
·    detailed commentary regarding the scope and impact of each proposed APP.
