Exemptions to NPP 2.1

 

Required or authorised by law - NPP 2.1(g)

 

Personal information may be used or disclosed for a secondary purpose if it is required or authorised by another law.

 

Many laws permit or require organisations to use or disclose personal information in ways that are inconsistent with NPP 2.  The exemption under NPP 2.1(g) and permits such uses and disclosures to take place.

Examples of such legal obligations include requirements:

• to report workplace accidents to occupational health and safety authorities;

• to provide information or documents pursuant to court orders or warrants;

• to permit taxation officers to take extracts from and copy documents;

• to report certain financial transactions to Austrac;

• to report a notifiable disease under public health legislation; and

• to report suspected child abuse.
